  • Summary

The <Decision of the Standing Committee of the National People's Congress on Amending the Individual Income Tax Law of the People’s Republic of China> was passed by the Standing Committee of the National People's Congress on 31 August 2018, and will be implemented effective 1 January 2019. One of the noticeable amendments is that expatriates (including Hong Kong residents) will be regarded as PRC tax residents and subject to Individual Income Tax (IIT) on their worldwide income in a tax year if their physical presence in China reaches 183 days in that tax year. BDO organises a seminar to share some updates and insights with our clients.    


The seminar will cover:

  • Key revisions to the IIT Law (eg, assessment of tax residency and anti-avoidance rules, etc.)
  • Comparison of the definitions of tax resident under the prevailing and new IIT Law and the relevant provisions on tax resident under the tax treaties

About the moderator

Carol Lam - Director of Tax Services, BDO

Carol Lam is the director of Tax Services in BDO in Hong Kong.

Carol has extensive experience in taxation practice in Hong Kong providing tax consulting and compliance services to multinational organisations, listed groups as well as private companies from a wide range of industries, including manufacturing, trading, retail, real estate, financial services, transportation, aircraft and logistics and professional firms. 
 
Carol is experienced in advising on tax-efficient operation, holding and financing structure, corporate restructuring, pre-listing tax planning, cross border transactions, transfer pricing, due diligence and mergers & acquisition deals.  She also has extensive experience in advising international assignees in structuring tax-efficient remuneration packages, and in representing clients in tax investigation and field audit cases and handling tax dispute settlement. 

Carol is a Fellow of the Association of Chartered Certified Accountants, a Hong Kong Certified Public Accountant, and a Council Member of The Taxation Institute of Hong Kong.

 

About the speaker

Leo Li - Principal of Tax Services, BDO

Leo Li is a principal of tax services.

With more than 15 years' tax experience, Leo has provided a full range of corporate tax advisory services including expatriate tax, foreign investments, customs and foreign exchange services in China. He also has extensive experience in advising tax due diligence reviews on mergers and acquisitions and IPO projects.

Leo's experience covers both international and local clients over a wide spectrum of industries including trading, manufacturing, logistics, business service and real estate development.

Before joining BDO, Leo had spent seven years working in Shenzhen for a leading international accounting firm as a member of its Japanese service team.

Leo is fluent in Japanese. He is a member of the Hong Kong Taxation Institute and a Certified Tax Adviser in Hong Kong. He holds a Bachelor degree in Japanese.
